MEDIATION

Jonathan Malits is an accredited civil / commercial and family mediator and is able to act as mediator in any type of dispute including divorce, employment and business matters. Mediations can take place in his Ellesmere Port offices or at any other location more convenient to both parties. The mediation fee is payable jointly by both parties.

Mediation is a voluntary, non-binding, “without prejudice” process in which a specially trained neutral third party attempts to bring out the issues and help facilitate an agreement between the parties.

For business disputes, the mediator aims to facilitate agreement between the parties with an eight-hour day. A family dispute invariably takes longer and might well necessitate meetings between the mediator and the couple initially, followed by meetings with their professional advisers and then meetings with all the parties.

The key advantages of mediation are:

Speed – Saves times and money.

Cost effective – Costs are kept to the minimum and are split equally between the parties in dispute.

Improves communication & understanding – The mediation process facilitates renewed communication between the parties and in doing so helps the parties to clarify the real issues.

Flexible – As mediation is voluntary, non-binding and without prejudice, there are no formal procedural rules. The parties have full participation in the decisions. The informal atmosphere encourages more creative solutions which the courts do not have.

Addresses reality – unreasonable expectations and claims will be addressed and moderated.

Confidential – the mediation process is voluntary and non-binding, it is above all, a totally confidential process
